
Scope of Work
Northern Floor and Epoxy agrees to furnish labor, materials, equipment, and services necessary to complete the work specifically outlined within this estimate. Any work requested outside the original scope, including unforeseen site conditions, repairs, additional preparation, material upgrades, or schedule changes, may require a written change order and additional charges.
Scheduling & Delays
Project scheduling dates are approximate and subject to change due to weather, material availability, manufacturer delays, hidden site conditions, or circumstances beyond contractor control. Northern Floor and Epoxy will make reasonable efforts to maintain project timelines but shall not be held responsible for delays outside its control.
Jobsite Access & Preparation
Client agrees to provide safe and unrestricted access to all work areas during the duration of the project. Unless otherwise stated in writing, the client is responsible for:
Removal of furniture, personal belongings, electronics, artwork, and valuables
Providing access to electricity, lighting, water, and climate control
Maintaining appropriate interior temperature and humidity conditions before, during, and after installation
Additional charges may apply for excessive preparation, moving items, delays, restricted access, or unsafe working conditions.
Material & Flooring Variations
Wood, concrete, epoxy, vinyl, and other flooring materials may contain natural or manufacturer variations in color, texture, grain, sheen, and appearance. Variations between samples and finished installations are normal and are not considered defects.
Wood flooring may naturally expand, contract, gap, cup, or shift due to seasonal and environmental changes. These conditions are not considered installation failures when installed in accordance with applicable NWFA standards and manufacturer guidelines.
Subfloor & Moisture Conditions
Northern Floor and Epoxy is not responsible for hidden or pre-existing conditions including but not limited to:
Moisture intrusion
Mold or mildew
Structural deficiencies
Uneven subfloors
Concrete cracking or movement
Existing floor failure
Improper prior installations
Any additional preparation, moisture mitigation, leveling, patching, or repair discovered during the course of work may require additional charges.
Dust Containment
Dust containment systems substantially reduce airborne dust but cannot eliminate all dust particles. Client acknowledges that some dust migration beyond the immediate work area may occur despite reasonable containment procedures.
Epoxy Flooring Systems
Concrete coatings and epoxy systems may display minor texture differences, patch visibility, roller patterns, repaired cracks, or variations caused by substrate condition and concrete porosity. Existing concrete imperfections may telegraph through finished coatings over time.
Scratching, impact damage, hot tire pickup, chemical exposure, moisture vapor transmission, and normal wear are not considered coating failures.
Payment Terms
Payment terms shall be as outlined within the estimate unless otherwise agreed upon in writing. Deposits, progress payments, and final balances are due according to the agreed payment schedule.
Final payment is due immediately upon substantial completion of the project.
Failure to make payments as agreed may result in:
Suspension of work
Delayed scheduling
Loss of warranty coverage
Collection proceedings
Interest charges
Mechanic’s lien proceedings
Returned checks may incur additional fees.
Late Payments & Collections
Outstanding balances may accrue interest at the maximum rate permitted by law. Client agrees to pay all reasonable collection costs, attorney fees, court costs, and expenses incurred by Northern Floor and Epoxy in connection with unpaid balances.
Right to Suspend Work
Northern Floor and Epoxy reserves the right to suspend or terminate work for nonpayment, unsafe conditions, lack of site readiness, customer interference, or circumstances beyond contractor control.
Warranty
Northern Floor and Epoxy warrants workmanship for the period outlined within the estimate documents. Manufacturer warranties apply separately through the respective product manufacturers where applicable.
Warranty coverage does not apply to:
Abuse or neglect
Scratching, dents, or impact damage
Pet damage
Water or moisture intrusion
Structural movement
Improper maintenance
Environmental or humidity-related movement
Damage caused by other trades or contractors
Normal wear and tear
Limitation of Liability
Northern Floor and Epoxy shall not be liable for incidental, indirect, special, or consequential damages including loss of use, relocation expenses, business interruption, or diminished property value.
Contractor liability shall not exceed the original contract amount paid for the affected work.
Insurance
Northern Floor and Epoxy maintains applicable business insurance coverage. Proof of insurance may be provided upon request.
Mechanic’s Lien Notice
In accordance with RSA 447:5, Northern Floor and Epoxy hereby gives notice to all interested parties that Northern Floor and Epoxy reserves the right to claim a mechanic’s lien on the above listed property should payment for labor, services, or materials not be paid in full upon completion of the project.
Acceptance
Approval of this estimate, payment of deposit, electronic signature, or authorization to begin work constitutes acceptance of all pricing, scope, terms, and conditions outlined herein.
